Equality Plans in companies - Spain

Since March 2019, and with a transitional period until 2022, companies with more than 50 employees are obliged to have an Equal Opportunities Plan between women and men in their organizations.

As we have already told them on other occasions, since March 2019, and with a transitional period until 2022, companies with more than 50 employees are obliged to have an Equal Opportunities Plan between women and men in their organizations. A new regulation that must be faced as a new opportunity.

Since 7 March 2020, companies with between 151 and 250 employees must have already approved equality plans.

From 7 March this year, equality plans must be approved by companies with between 101 and 150.

From 7 March 2022, equality plans must be approved, companies between 50 and 100.

The latest legislative reforms(Royal Decree 901/2020 and Royal Decree 902/2020)also oblige companies to register their Equality plans,as well as to have a remuneration audit. This new regulatory framework, although it enshrines the right to collective bargaining in matters of equality,determines that, ultimately, the obligation to have an equality plan corresponds to the company .

In this sense, the Law on Infringements and Sanctions in the Social Order(RDL 5/2000)establishes penalties that go from 6,251 euros to 187,515 euros for the breach of these obligations.

Likewise, integrating the Equality Plan as a guarantee of quality and business excellence will facilitate the reporting of sustainability reports and non-financial information states, as well as the fulfilment of the Sustainable Development Goal (SDD) 5 and the 2030 Agenda.
